2007 CLIENT UPDATE 

It is our pleasure to continue offering you the highest quality legal services at reasonable rates.  We are also very proud of the fact that our number one source of clients continues to be referrals from clients. 

Thus far 2007 has exceeded our expectations. Our new office's easy parking and location have made the transition smooth.  Also, I have been fortunate to serve as a Legal Commentator for Fox National News.  I "shoot" the appearances from Kansas City via satellite.  As of this date, I have appeared on topics from Anna Nicole Smith, the NASA Astronaut assault case, the Duke Lacrosse Rape Case, as well as many other national stories.  My next appearance will mark my twentieth appearance on Fox.     If you haven't had a chance to catch the programs, our website will soon have the videos uploaded for you to watch.    Normally, I am on at 4:30 p.m. on Saturdays for the show called the Big Story with Julie Banderas.  While I enjoy the TV appearances, I still prefer to duke it out in Court.  Having spent 2006 working on a high profile case, I was very pleased when the prosecutor finally realized the case was charged incorrectly and dismissed the case and dropped the charges that had been filed against our client.

Harrassment or Stalking

 

A person commits the offense of harassment when he or she performs any of the following acts with the intent to harass, annoy, alarm, abuse, torment, or embarrass another person: (1) when he or she initiates a communication with the other person by telephone, in writing, or electronically and makes an obscene comment or suggestion; (2) when he or she threatens by telephone, in writing, or electronically to inflict bodily injury on the other person or to commit a felony against the other person, a member of his or her family, or his or her property; (3) when he or she conveys a false report to the other person that another person has died or has been seriously injured.. Criminal Forfeitures

 

Criminal forfeiture actions are generally thought of as a quasi-criminal matter. Criminal forfeiture involves the literal forfeiture of the defendant's personal or real property. Appellate Review of Comments During Closing Arguments and Standards of Review

 

When a defendant appeals his conviction on the basis that the trial court erred in overruling his objection to the prosecutor's improper comments made during closing arguments, the appellate court will analyze the entire closing argument. PERSONAL INJURY LAW UPDATE

TORT ACTION FOR DANGEROUS EMPLOYMENT OF A MINOR CHILD

 

A person who employs a minor child in a dangerous occupation may be liable to the child's parent for harm that is sustained by the child. An occupation is considered to be dangerous if it involves a risk of death or serious bodily harm because of the age and inexperience of the child. The occupation does not have to be dangerous for an adult in order for the employer to be liable to the parent.

 

Vicarious Liability

 

A person may be liable for a tort even if he committed no wrong against a plaintiff. The doctrine of vicarious liability imposes liability on a person because of his relationship with the wrongdoer. The wrongdoer's liability is actually imputed to that person. That means if you employ or engage an agent to work for you, you must be careful when hiring employees or engaging agents to work for you as you could be liable.

TORT ACTION FOR CAUSING A MINOR CHILD TO LEAVE HOME

 

Under the common law, a person who compels or induces a minor child to leave his or her home or to not return to his or her home is liable to the parent of the minor child for damages.
